1. Appointments, Payments, and Copyright
1.1 Appointments:
One Hour Photo Studio operates on an appointment basis for all photography sessions. Clients must schedule their sessions in advance, subject to availability.
1.2 Deposits:
A non-refundable deposit is required to secure an appointment. The amount of this deposit will be specified during the booking process and will be applied towards the total cost of the photography session.
1.3 Session Fees and Payment Requirements:
Full payment for the session is required before commencing any work, unless otherwise stipulated in a separate contract between the client and the studio. All payments, including deposits and session fees, are non-refundable.
1.4 Copyright Ownership:
One Hour Photo Studio retains full copyright ownership of all images captured during the photography session. We reserve the right to use these images for publishing or advertising purposes without notifying the client. Clients grant One Hour Photo Studio a perpetual, irrevocable license to use the images for these purposes.
1.5 Digital Images:
For packages that include digital images, clients are permitted to make edits and print photos at any lab of their choosing, while One Hour Photo Studio retains copyright ownership of the images.
1.6 Image Storage Duration:
Images stored on our computers or servers will be retained for a maximum of 30 days from the creation of the order or session. After this period, all images will be automatically deleted. The studio will not attempt to recover images once they are deleted. It is the client’s responsibility to ensure they retrieve their images within this timeframe.
1.7 Client Responsibility for Follow-Up:
Given that the studio manages multiple clients, it is the client’s responsibility to follow up with the studio to ensure their product or service is delivered as expected. The studio is not liable for any delays or issues arising from a client’s failure to check on the status of their order.
1.8 Limitation of Liability:
One Hour Photo Studio will take reasonable precautions to safeguard images. However, in the event of loss or damage to images while in our possession, the studio may, at its discretion, offer a complimentary service equivalent to the lost or damaged service, up to the value of the original order. This offer is not guaranteed and will be provided based on availability.
The studio will not provide reshoots or reschedules due to customer faults, including but not limited to failure to pick up images or make pose selections within 30 days of the creation of the order or session. Reshoots or reschedules will be considered only under exceptional circumstances at the studio’s sole discretion.
1.9 Limitation of Liability for Injuries:
To the fullest extent permitted by applicable law, One Hour Photo Studio shall not be liable for any injuries, including physical or emotional harm, sustained by clients or their guests while on our premises. Clients are responsible for their own safety and that of their guests. By using our services, clients agree to indemnify and hold harmless One Hour Photo Studio, its employees, and agents from any claims, damages, or liabilities related to such injuries.
2. Payment Methods
2.1 Payment Methods:
When making a purchase on our Website, clients may use various payment methods, including Apple Pay and Credit/Debit Cards. Each payment method has its own terms and conditions, and by using these methods, clients agree to comply with the terms set by the respective payment processors. One Hour Photo Studio is not responsible for any issues or disputes arising from transactions conducted through these third-party payment processors.
3. Client Responsibilities and Changes to Appointments
3.1 Rescheduling Policy:
One Hour Photo Studio generally does not permit rescheduling of appointments. However, in exceptional circumstances, rescheduling requests may be considered. Whether rescheduling is granted free of charge or subject to an additional fee is at the sole discretion of One Hour Photo Studio.
3.2 Late Arrival:
Clients must arrive on time for their scheduled appointments.
Bookings Requiring a Deposit:
Clients arriving more than 15 minutes late will forfeit their deposit. Clients arriving more than 25 minutes late will need to reschedule for another available date or time.
Bookings Requiring Full Payment:
Clients arriving more than 15 minutes late will incur a $60 late fee. Clients arriving more than 30 minutes late will be considered a “no show,” and their booking will be canceled without a refund of any payments made.
4. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
5. Security, Hacking, and Legal Provisions
5.1 Security Measures:
While we employ reasonable measures to secure our Website, we cannot guarantee the absolute security of information transmitted over the internet or stored electronically. Any information provided or transactions conducted online are done at the client’s own risk.
5.2 Unauthorized Access:
One Hour Photo Studio is not responsible for any unauthorized access to our systems, servers, or data, including but not limited to hacking or other malicious activities. While we take reasonable precautions, absolute security cannot be guaranteed.
5.3 Limitation of Liability:
To the fullest extent permitted by applicable law, One Hour Photo Studio shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the Website or any content provided therein.
5.4 Third-Party Links:
The Website may contain links to third-party websites. One Hour Photo Studio does not endorse or control these sites and is not responsible for their content, security, or any damages incurred through the use of these external sites.
5.5 Changes to Terms and Conditions:
One Hour Photo Studio reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Website. It is the client’s responsibility to regularly review these Terms to stay informed of any modifications.
